Terms of Use

These Terms of Use ("Terms") are an agreement between you and MoFinicka LLC, an Arizona limited liability company ("we," "us"), the maker of Atmosphere. By creating an account or using Atmosphere (the "Service"), you agree to these Terms and our Privacy Policy. If you don't agree, don't use the Service.
The app
Atmosphere is a private sensory journal for iOS (and, when released, Android). It is a paid product: try it with a free trial when offered, then continue with a subscription. We may add, change, or remove features as we improve the product.
Eligibility
You must be at least 13 years old to use Atmosphere (or the minimum age of digital consent in your country, if higher). If you are under 18, you may use the Service only with the involvement and consent of a parent or guardian, including for any purchase.
Your license to use Atmosphere
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Atmosphere app on devices you own or control, as permitted by these Terms and the usage rules of the app store you downloaded it from. You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the Service, except where the law permits it despite this restriction.
Billing and subscriptions
Subscriptions are sold through Apple's App Store (and, on Android, Google Play). The app store handles payment, renewal, cancellation, and refunds under its own terms.
Auto-renewal: Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends.
Free trial: If a free trial is offered, your subscription begins and payment is charged when the trial ends, unless you cancel before then. Unused trial time is forfeited when you purchase.
Cancelling: Cancel or change plans anytime in your Apple ID (or Google Play) subscription settings. Deleting the app does not cancel a subscription.
Refunds: Refund requests are handled by the app store under its policies, not by us.
Prices are shown in the app at the time of purchase and may change for future billing periods with notice through the app store.
Your journal and your content
You own the content you log — notes, tags, photos, and entries ("Your Content"). You grant us a limited license to host, store, process, back up, and display Your Content solely to operate and improve the Service (sync, Gallery, search, export, and similar features). This license ends when you delete the content or your account, except for residual copies in routine backups, which are purged on a rolling basis.
You are responsible for Your Content. Don't log content you don't have the right to use, or content that is unlawful.
You can export your journal as a CSV and delete individual logs or your entire account in the app. Account deletion permanently removes your auth account, logs, queue, and uploaded photos.
Moment photos may be subject to a generous fair-use storage ceiling to keep the service running. This is a cost-protection measure, not a second paid tier.
Third-party content and services
Atmosphere displays media information (such as titles and cover art) from third-party sources, including the Apple iTunes Search API, Wikipedia / Wikimedia, Open Library, and Google Books. Atmosphere is not affiliated with, endorsed by, or sponsored by Apple Inc. or the Wikimedia Foundation. Third-party content belongs to its respective owners, and your use of it through the Service doesn't grant you any rights in it. We are not responsible for the accuracy or availability of third-party data.
Acceptable use
Don't abuse the Service. Specifically, you may not: attempt to breach or probe its security; interfere with its operation or other users' use of it; access it with automated tools (scraping, bulk downloading); resell or commercially exploit it; use it to store or share unlawful content; or use it for anything illegal. We may suspend or terminate accounts that violate these Terms, with or without notice depending on severity.
Intellectual property
Atmosphere — including its design, code, vibe library, and branding — is owned by MoFinicka LLC and protected by intellectual property laws. These Terms don't grant you any rights in the Service except the limited license above.
Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that your content will never be lost — export regularly if your journal matters to you (we've made that easy on purpose).
Limitation of liability
To the fullest extent permitted by law, MoFinicka LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or loss of goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim arose or (b) US $50. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
Apple-specific terms
If you downloaded Atmosphere from Apple's App Store: these Terms are between you and MoFinicka LLC only, not Apple. Apple has no obligation to provide maintenance or support for the app. If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing claims relating to the app, including product liability, legal or regulatory compliance, or consumer protection claims, or third-party claims that the app infringes intellectual property rights. You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government restricted-party list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
If the service changes or ends
We may update, suspend, or discontinue Atmosphere. If we shut it down, we'll make reasonable efforts to give advance notice and keep export available for a reasonable period. Subscriptions are managed by the app store — cancel there if you no longer want access.
Changes to these Terms
We may update these Terms. If a change is material, we'll give notice in the app or by email before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to their jurisdiction. Nothing in this section limits any non-waivable consumer rights you have under the laws of your place of residence.
